Terms of Service for MixPix

Welcome to MixPix! These Terms of Service ("Terms") govern your use of the MixPix service, which allows you to generate couple pictures using AI models ("Service"). By using our Service, you agree to these Terms. If you do not agree to these Terms, you must not use our Service.

1. Acceptance of Terms

By accessing or using the Service, you signify that you have read, understood, and agreed to be bound by these Terms.

2. User Responsibilities

• User Content: You are solely responsible for the headshot photos ("User Content") that you upload to the Service. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize MixPix to use all intellectual property rights in and to any User Content.
• Permissions: You must not generate images using headshots of individuals who have not given you explicit permission to use their image. It is your responsibility to obtain such permissions.
• Compliance with Laws: You agree to comply with all local, state, national, and international laws and regulations applicable to your use of the Service.

3. Use of the Service

• AI Model: The Service is based on Stable Diffusion AI technology, which may generate not safe for work (NSFW) images. You agree to use discretion and abide by all applicable laws when using the Service.
• Restrictions on Use: NSFW images generated by the Service must not be used, shared, or distributed in any form. You agree to immediately delete any NSFW images generated through the Service.

4. Limitation of Liability

• Indemnification: MixPix is not liable for any claims, damages, or liabilities arising from your use of the Service. You agree to indemnify, defend, and hold harmless MixPix and its affiliates, officers, agents, employees, and partners from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.
• Disclaimer: The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. MixPix does not guarantee that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.

5. Changes to Terms

MixPix reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MixPix operates, without regard to its conflict of law provisions.

7. Intellectual Property Rights and Use of Generated Content

• AI Super Models: The AI super models' faces, bodies, and any related attributes are proprietary to MixPix or its licensors ("AI Super Models' Owners"). You acknowledge that you do not acquire any ownership rights by using the Service to generate images with AI super models. The use of the AI super models' images is restricted solely to personal, non-commercial use within the scope of the Service. You are not permitted to use the AI super models' faces, bodies, or any part of the generated content outside of this Service without explicit written consent from the AI Super Models' Owners.
• Restrictions on Generated Content: The content generated by the Service ("Generated Content") is for your personal, non-commercial use only. You may not use, sell, license, distribute, or otherwise exploit the Generated Content for promotional, advertising, or monetary purposes without obtaining explicit written consent from the AI Super Models' Owners. This includes, but is not limited to, using Generated Content for marketing materials, merchandise, or any form of media distribution.
• Copyright: All rights, titles, and interests in and to the Generated Content, excluding User Content incorporated into the Generated Content, remain with MixPix or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Generated Content in accordance with these Terms. This license does not include any rights to reproduce, distribute, publicly display, or create derivative works from the Generated Content, except as expressly permitted under these Terms.
